Tacoma medical marijuana "dispensaries" under attack

Medical marijuana patients and their caregivers were stunned Friday, Oct. 15, when several of Tacoma's so-called marijuana dispensaries were served cease and desist orders from the City of Tacoma's Tax & Licensing Division. The orders, with carbon copies to Tacoma Police Department Chief Don Ramsdell and Lt. Shawn Stringer, included what appears to be the City of Tacoma's declared official stance on patient cooperatives operating in Tacoma, some for over a year.

Patient co-ops were given until Oct. 24 to close up or face revocation of their Registration and Annual Business License, which may include fines and penalties up to and including criminal prosecution. One co-op operator said he was told by city officials that they would face police raids if they didn't comply with the order.

City of Tacoma officials have not responded for comment yet as the cease and desist orders were served on Friday, and the Weekly Volcano did not learn of them until after regular business hours. 

Director of C.O.B.R.A. Medical Group Emiel Kandi, who met with state lawmakers today to discuss medical marijuana issues, issued an official statement in response to the letter that arrived in his Post Office box.

"You have no right," he writes. "The people of the State of Washington have already spoken. The people passed Initiative 692 over a decade ago. The people have recognized the usefulness and necessity of cannabis for medical purposes, why can’t you? You began with a hands-off policy by law enforcement, allowing these types of businesses and patient-cooperatives to open and flourish. You then tried using scare tactics to convince us that we should go away, once you had changed your minds. Now you attack us using a legally flawed interpretation of a state law designed to help the most vulnerable. You should be ashamed."

Proponents of medical marijuana have issued a call to arms of sorts, asking local supporters to attend the City Council meeting scheduled for Tuesday, Oct. 19.

Everyone, we need to drop what we're doing and rally on this Tuesday meeting. This kind of aggressive action from a local body of government towards a safety-enhancing crime-preventing patient cooperative can't go un-matched. We all have people in our lives who are affected by these kinds of arbitrary decisions. Let their voices be heard on Tuesday. Some people are alive and eating food because of medical cannabis, how can anyone want to send them back to the black market for their medicine? This is immoral. We call on the City to cease and desist!

CO-OPS and Dispensaries are not included in the law, it needs to be changed, at least vote for officials (prosecutors and Judges) who have your back!

this is shameful action by the city of Tacoma. these are the same tactics they used to go after the Tacoma Hemp Company business license. the city and police have known about these legally licensed and taxpaying businesses since they opened. we were all open with the police and city, inviting them in. to be shutting down viable business in an economic wreck such as we have, and to force what is now THOUSANDS of medical marijuana patients who have found safe, above ground places to find medical grade cannabis back to the streets and black market to find cannabis? this makes no sense, does not in any way reduce the amount of marijuana issues the city and police have now forced on the citizens of Tacoma.
if patients can't find medicine in Tacoma, they will have to buy from the streets, or go to places like PORT ANGELES OR SEATTLE. places that understand the will of the people in Washington was not to intimidate and harrass sick people away from relief.

Cannabis Defense Coalition mailed a public records request to City of Tacoma's City Clerk's Office today for access to and copies of notices to cease dispensing marijuana issued on behalf of the City of Tacoma in October of 2010, along with related documentation of service of those notices. Washington's Public Records Act requires a response within five business days of receipt of request, so we expect a response by Tuesday, October 26, 2010.
